1. ACCEPTANCE OF TERMS
By accessing, browsing, or using the services provided by Sell For Less ("Company," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Sell For Less.
If you do not agree to these Terms, you must not access or use our services. Your continued use of our services following any changes to these Terms constitutes acceptance of those changes.
These Terms apply to all users of our services, including without limitation users who are browsers, clients, customers, and/or contributors of content.
2. SERVICE DESCRIPTION
Sell For Less provides cost-reduction strategies for selling homes without sacrificing results. Our services are designed to help homeowners maximize their net proceeds while minimizing selling costs.
Services Offered:
Low-Cost Selling Strategy: We provide consultation and strategic planning to help you sell your home using cost-effective methods while maintaining competitive market positioning. This includes analysis of your property, market conditions, and customized recommendations for reducing unnecessary expenses in the selling process.
Pricing & Net Proceeds Guidance: We offer professional guidance on pricing your property competitively and calculating your estimated net proceeds. This includes comparative market analysis, pricing strategy development, and detailed breakdowns of potential costs and returns.
Transaction Support: We provide ongoing support throughout your home selling transaction, including assistance with documentation, coordination guidance, and answers to questions that arise during the selling process.
Service Limitations: Our services are consultative and educational in nature. We do not act as licensed real estate agents or brokers unless explicitly stated otherwise. We do not guarantee the sale of your property, specific sale prices, or timeframes for completion of sale.
The scope, deliverables, and timeline for services will be specified in individual service agreements or proposals. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to affected clients.
3. USER OBLIGATIONS
As a client of Sell For Less, you agree to:
Provide Accurate Information: Supply complete, accurate, and truthful information about your property, financial situation, and selling objectives. You acknowledge that the quality and accuracy of our guidance depends on the information you provide.
Timely Communication: Respond to our requests for information, documentation, or clarification in a timely manner. Delays in communication may affect our ability to deliver services effectively.
Legal Compliance: Ensure that you have legal authority to sell the property in question and comply with all applicable laws, regulations, and disclosure requirements related to real estate transactions.
Independent Verification: Conduct your own due diligence and seek independent professional advice as needed, including legal, tax, and financial counsel. Our services are not a substitute for licensed professional advice in these areas.
Respectful Conduct: Maintain professional and respectful communication with our team members and cooperate in good faith throughout the service relationship.
Confidentiality: Maintain confidentiality of any proprietary methods, strategies, or materials we share with you that are marked as confidential or proprietary.
Financial Obligations: Pay all fees in accordance with the payment terms specified in your service agreement.
You acknowledge that failure to meet these obligations may impact the quality of services we can provide and may result in termination of services.
4. APPOINTMENT SCHEDULING AND CANCELLATIONS
Scheduling Appointments: Appointments for consultations and services may be scheduled through our designated scheduling system, by email, or by phone. All appointments are subject to availability and confirmation by Sell For Less.
Confirmation: You will receive confirmation of your scheduled appointment via email. It is your responsibility to ensure we have your correct contact information.
Rescheduling: If you need to reschedule an appointment, please provide at least 24 hours advance notice. Rescheduling requests should be submitted via email to Lara.Hart@sellforless.info or through our scheduling system.
Cancellation Policy: Cancellations must be made at least 24 hours in advance of the scheduled appointment time. Cancellations made with less than 24 hours notice may be subject to a cancellation fee as specified in your service agreement.
No-Show Policy: Failure to appear for a scheduled appointment without prior cancellation will be considered a no-show. No-show appointments may be subject to the full appointment fee and may affect your ability to schedule future appointments.
Company Cancellations: We reserve the right to cancel or reschedule appointments due to emergencies, illness, or circumstances beyond our control. In such cases, we will make reasonable efforts to notify you as soon as possible and reschedule at your convenience without penalty.
Late Arrivals: If you arrive more than 15 minutes late for a scheduled appointment, we reserve the right to reschedule the appointment or reduce the appointment time accordingly.
5. PAYMENT TERMS
Fee Structure: Fees for our services will be specified in individual service agreements, proposals, or fee schedules provided to you prior to engagement. Fees may be structured as flat fees, hourly rates, or percentage-based compensation depending on the services selected.
Payment Methods: We accept payment via credit card, debit card, electronic bank transfer, and such other methods as we may specify. Payment processing may be handled by third-party payment processors.
Payment Timing: Unless otherwise specified in your service agreement, payment terms are as follows:
- Initial consultation fees are due at the time of scheduling
- Service retainers or deposits are due upon signing of service agreement
- Remaining balances are due according to the payment schedule specified in your service agreement
- Invoices for ongoing services are due within 15 days of invoice date
Late Payment: Payments not received by the due date may be subject to a late fee of 1.5% per month (or the maximum rate permitted by law, whichever is less) on the outstanding balance. We reserve the right to suspend services for accounts with overdue balances.
Refund Policy: Refund eligibility depends on the specific services purchased and will be outlined in your service agreement. Generally, deposits and fees for services already rendered are non-refundable. Requests for refunds must be submitted in writing to Lara.Hart@sellforless.info.
Disputed Charges: If you believe you have been incorrectly charged, you must notify us in writing within 30 days of the charge. We will investigate all disputed charges and respond within a reasonable timeframe.
Taxes: All fees are exclusive of applicable taxes unless otherwise stated. You are responsible for all sales, use, value-added, and other taxes associated with the services, except for taxes based on our net income.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Sell For Less and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of or inability to access or use our services
- Any conduct or content of any third party in connection with our services
- Any content obtained from our services
- Unauthorized access, use, or alteration of your transmissions or content
- Real estate market conditions or changes in property values
- Financial losses related to the sale or attempted sale of your property
- The amount of time required to sell your property or failure to sell your property
- Advice, recommendations, or strategies that do not produce expected results
- Your reliance on information or guidance provided through our services
- Errors or omissions in our services or materials
In no event shall the total aggregate liability of Sell For Less for all claims relating to our services exceed the total amount of fees actually paid by you to Sell For Less in the six months preceding the event giving rise to liability.
Consultation Nature: You acknowledge that our services are consultative in nature and that results from real estate transactions depend on numerous factors beyond our control, including market conditions, property condition, buyer behavior, and your implementation of recommendations.
No Guarantees: We make no guarantees regarding the sale price, timeframe for sale, or amount of cost savings you will achieve. Real estate outcomes are inherently uncertain and dependent on many variables.
Independent Decisions: You acknowledge that you make all final decisions regarding your property and its sale. We provide guidance and recommendations, but you retain full decision-making authority and responsibility for outcomes.
Third-Party Actions: We are not liable for the actions, errors, or omissions of third parties you may engage, including real estate agents, attorneys, inspectors, appraisers, or buyers.
7. WARRANTY DISCLAIMERS
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Sell For Less does not warrant that:
- Our services will meet your specific requirements or expectations
- Our services will be uninterrupted, timely, secure, or error-free
- The results obtained from using our services will be accurate, reliable, or achieve specific outcomes
- Any errors in our services or materials will be corrected
- Our guidance will result in the sale of your property within any particular timeframe or at any particular price
No Professional Relationship: Unless explicitly stated otherwise in writing, our services do not create an attorney-client, accountant-client, or licensed real estate agent-client relationship. You should seek independent professional advice for legal, tax, and regulatory matters.
Information Accuracy: While we strive to provide accurate and current information, we make no warranties regarding the accuracy, completeness, or timeliness of information provided. Real estate markets and regulations change frequently, and information may become outdated.
Third-Party Information: We may provide or reference information from third-party sources. We do not warrant the accuracy or reliability of such third-party information and are not responsible for errors or omissions in third-party content.
Individual Results: You acknowledge that results from real estate transactions vary based on numerous factors and that past results or examples do not guarantee similar outcomes for your situation.
8. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sell For Less operates, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or our services shall be resolved in the appropriate courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with any service agreements, proposals, or other documents incorporated by reference, constitute the entire agreement between you and Sell For Less regarding our services and supersede all prior agreements and understandings.
